Vilma urges rejection of Goodell motion to dismiss

NEW ORLEANS (AP) ? Jon Vilma urged a federal judge Friday to reject NFL Commissioner Roger Goodell's motion to dismiss the defamation lawsuit filed against him by the Saints linebacker.

Vilma's request to U.S. District Judge Ginger Berrigan argues Goodell acted with "reckless disregard for the truth" when basing initial allegations about Vilma upon one fired Saints assistant, Mike Cerullo, whose testimony has been inconsistent and challenged by other witnesses in the NFL's bounty probe of the Saints.

The motion centers on Goodell's public comments that Vilma held up $10,000 cash in a team meeting in 2010, offering it to anyone who knocked Arizona quarterback Kurt Warner out of a playoff game.

During recent NFL appeal hearings in the bounty case, former Saints defensive coordinator Gregg Williams testified he never saw any money.

"Williams has always told Goodell, and continues to state, that there was never any cash put up for a bounty on any player. It was 'just talk.'" Vilma's motion reads. "Nonetheless, Goodell irresponsibly chose to contend that Vilma walked around with $10,000 before the Cardinals game."

Vilma's season-long suspension and with various shorter bans for three other players were thrown out Tuesday by former Commissioner Paul Tagliabue, who Goodell had appointed to oversee the appeals of player punishment.

After Tagliabue's decision, the NFL Players Association dropped claims in federal court on behalf of Saints defensive end Will Smith and two former Saints: Cleveland linebacker Scott Fujita and free agent defensive lineman Anthony Hargrove. Vilma dropped his claims against the league concerning the disciplinary process, but moved forward with his defamation case against the commissioner, asking Berrigan to allow discovery, which consists of the collection of evidence and deposing of witnesses. Berrigan has so far delayed discovery while the Goodell's motion to dismiss the case is pending.

In their effort to highlight how unreliable Cerullo was, Vilma's attorneys, Peter Ginsberg and Duke Williams, cite hearing testimony from Saints assistant head coach Joe Vitt, who said Payton once arranged for police protection at his former suburban family home while he was away at league meetings because the head coach feared Cerullo was emotionally unstable and might harm his family.

While the lawsuit does not quote the testimony from the closed-door hearing directly, it appears in transcripts obtained by The Associated Press.

"An email was sent to the League about Mike Cerullo long before these (bounty) charges were brought up on our football team saying that Mike Cerullo was crazy, that Sean Payton had to have a police escort or, excuse me, police protection at his house because he was going to the owners' meeting, and he was worried about his family with Cerullo," Vitt testified. "This is the kind of guy we're dealing with. Allright?"

Vilma's motion also notes that the NFL subsequently dropped Goodell's initial allegation about Vilma physically holding up money in the meeting before the Arizona game.

"There can no longer be any doubt that Goodell acted with malice ... in making this quasi-criminal accusation against Vilma," the motion said.

The NFL continues to allege that Vilma offered a $10,000 to anyone who knocked then-Minnesota quarterback Brett Favre out of the 2010 NFC title game, which followed the Arizona game. Williams testified that he recalled such an offer for that game, but never saw any money change hands and suggested the offer represented nothing more than tough talk in an emotional meeting that he allowed to get out of hand.

Connecticut Shooting: How to Talk to Your Kids

It's going to be a tough weekend for parents who have children with questions about Friday's mass shooting at an elementary school in Connecticut. The biggest question that children and parents may be asking is "Why?" but what they may really be asking is for reassurance that they are safe.

"All children need to be able to know you are there listening to them," the American Psychologists Association (APA) advised on its website.?

Dr. Paul Coleman, psychologist and author of the book "How to Say It to Your Child When Bad Things Happen" (Prentice Hall Press, 2002), offers advice specifically for parents with younger children under age 8. In his book, he tells parents to keep the explanation simple and reassure their children that they won't be shot at school.

"Parents may feel like they're lying, since no one can ever be 100 percent sure of what the future holds, but probability estimates are not something small kids can grasp, and won't comfort them," Coleman wrote.

Psychologists agree that older children may want to know how they can help. For instance, after Hurricane Sandy, young people on Tumblr donated more than $300,000 to the relief effort. Similar campaigns are already emerging to assist the Newtown community, such as a fundriser on Kickstarter-like site?HopeMob.

Children may use their social media channels to keep up on the news and express their grief. But the APA cautioned parents to make sure their kids take a break from the media ? and advised that parents do the same. [See also: Twitter and Facebook Grapple with Age Limits]

"It is important to limit the amount of time spent watching the news because constant exposure may actually heighten their anxiety and fears," the APA said.

No more lying about your age: Scientists can now gauge skin?s true age with new laser technique

Dec. 13, 2012 ? Wrinkles, dryness, and a translucent and fragile appearance are hallmarks of old skin, caused by the natural aging of skin cells. But while most of us can recognize the signs of lost youth when we peer into the mirror each morning, scientists do not have a standardized way to measure the extent of age damage in skin. Now a group of Taiwanese researchers has used a specialized microscope to peer harmlessly beneath the skin surface to measure natural age-related changes in the sizes of skin cells.

The results, which are published in the Optical Society's (OSA) open-access journal Biomedical Optics Express, can be used to study the general phenomenon of skin aging and may help provide an index for measuring the effectiveness of 'anti-aging' skin products.

In the study, Chi-Kuang Sun, a distinguished professor at National Taiwan University and chief director of the university's Molecular Imaging Center, along with medical researcher and dermatologist Yi-Hua Liao and colleagues, evaluated 52 subjects ranging in age from 19 to 79 years old. The researchers focused a brief burst of infrared laser light into the skin of the subjects' inner forearms, an area that is generally protected from sun damage, which accelerates natural aging. The beam penetrated to a depth of about 300 millionths of a meter, or approximately where the epidermis (the upper layer of skin) and the dermis (the lower layer) meet.

The researchers used a technique known as harmonic generation microscopy (HGM), which has previously been used to study developing embryos. In the procedure, a concentrated beam of photons is sent into a material. The photons naturally oscillate at a particular frequency, and as they interact with the material, they generate "harmonics" -- vibrations that are multiples of the original frequency, which are characteristic of the material structure and properties. For example, the second harmonic is twice the original frequency and the third harmonic is three times the original frequency. In an imaging system, harmonics can reveal different structures at very high resolution. In their study, the team scanned for reflected second and third harmonic photons, and from those measurements, produced a high-resolution 3-D map of the tissue that revealed structures within the skin cells.

Natural aging, the scanning showed, caused a significant increase in the overall size of cells known as basal keratinocytes -- the most common cells in the outermost layer of skin -- as well as in the sizes of their nuclei. However, other types of skin cells, known as granular cells, did not show a similar pattern. Thus, says Sun, the relative changes in the two types of cells can serve as an index for scoring natural or "intrinsic" skin aging -the aging of skin caused by programmed developmental or genetic factors.

"No one has ever seen through a person's skin to determine his or her age from their skin," says Sun. "Our finding serves as a potential index for skin age."

A skin age index would provide a standardized, quantitative scale that could be used rate the true "age" of skin, from young (less age-related damage) to old (more age-related damage). The scale could give doctors another tool to monitor the overall health of skin -- by investigating whether the skin of certain individuals or populations ages faster or slower than average, tracking the aging of an individual's skin over time, or testing how effective anti-aging treatments are at slowing the rate of skin aging.

Intrinsic, or chronological, aging is different from extrinsic aging, which is caused primarily by sun exposure. "There are a lot of extrinsic factors that can accelerate the aging process, such as smoking, ultraviolet light, and stress," says Sun. The researchers found that the extent of extrinsic skin aging in their study subjects varied depending on occupation, personal habits, and skin type, but because the researchers looked at skin on the sun-protected inner forearm, their findings provide a measure of the primarily genetically-based intrinsic skin aging.

"This could provide an index for someone who cares about the health of their skin and might also provide a test-bed for measuring the effectiveness of 'anti-aging' skin products," Sun says. "Of course," he and Liao joke, "you could set an HGM scanner at the entrance to a bar, so you can know whether a person is over 21 years old and permitted for entry."

The story of continuing weakness in US construction labor markets seems puzzling. Construction payrolls hit a new multi-year low (discussed here), yet both housing starts and construction spending have picked up.

Merrill created a chart that shows construction jobs as percentage of housing inventory in the US. That ratio is at the lowest level since recordkeeping began.

Merrill argues that it's a sure sign of construction payrolls bottoming out.

Merrill: - One way to gauge the amount of potential construction hiring is to compare construction jobs to the housing stock. Naturally, the housing stock has grown at a slowing pace over the past several years given the sharp decline in the pace of new construction. But we believe the decline in construction jobs was excessive ? the ratio of construction jobs to the housing stock is at a record low (data go back to 1965), just slightly below the troughs of prior housing cycles. This suggests construction companies are operating with reduced headcount relative to prior downturns.

They are probably correct, but it seems the industry may have sufficient slack to increase output without significantly increasing payrolls. Here is a simple exercise. Let's take residential construction spending in the US, adjust it for inflation and see how many resi construction payrolls are deployed per one million dollars in spending. For example if we spend $24bn per month on residential construction and resi construction payrolls in the US are 560K, that represents 23 workers per $1 million spent in a month. The lower the number of workers, the more "headcount efficient" the industry is.

The industry seems to be improving its efficiency in recent months, but still has a great deal of room to go. Construction was most efficient during the building peak in early 2006. That's because the sheer volume of homes under construction allowed for high efficiency (just as most industries become more efficient with increased volumes). This tells us that the industry indeed has some slack and can increase output without proportionally increasing payrolls. Which means that if construction booms in 2013 (as many expect it), jobs will certainly increase but at a much slower pace (at least initially).

Defiant North Korea launches long-range rocket into orbit

United States officials confirm that North Korea appears to have carried out the successful launch of a long-range rocket.

The move comes as a surprise to the international community, which has consistently called on North Korea to abandon its efforts.

Less than 24 hours earlier, the North Koreans had indicated they were grappling with "technical uncertainties" that forced them to extend the launch window to Dec. 29.

The secretive regime insists its efforts are part of a peaceful space program intended to place a satellite into orbit. But the U.S. and key Asian allies believe it is a thinly disguised attempt to test an intercontinental ballistic missile aimed at furthering development of the technology needed to mount a nuclear warhead on a long-range rocket that could one day reach the U.S.

National Security Council spokesman Tom Vietor called the launch a "highly provocative act that threatens regional security."

In recent weeks even China, North Korean's only remaining ally, sent a high level delegation into Pyongyang to convey a message of constraint. Today, China expressed "regret" over the incident. In the past, China has supported North Korea's right to develop its space program.

"The action is yet another example of North Korea's pattern of irresponsible behavior," read the National Security Council statement. "The United States remains vigilant in the face of North Korean provocations and is fully committed to the security of allies in the region."

North American Aerospace Defense Command (NORAD) acknowledged the launch initiated at 9:49 a.m. local time and followed its intended trajectory, traveling south between Korea and Japan.

"At no time was the missile or the resultant debris a threat to North America," said NORAD.

Japan's emergency alert system ? M-NET ? recorded the rocket's flight path directly over Okinawa just after 10:00 a.m. Officials say they have located three points of debris: One in South Korea's Yellow Sea, a second location further down the country's west coast and the third point 180 miles north of the Philippines.

A South Korean military official confirmed that one of their three warships, equipped with the Aegis radar system, detected the launch. The first stage fell just below Byeonsanbando, southwest of the Korean peninsula, exactly where it was supposed to, according to the official.

Increased attention focused on North Korea in recent weeks as satellite images showed action at the Tongchang-ri launch site. But on Monday, a statement from the Korean Committee of Space Technology claimed that scientists and technicians "found a technical deficiency in the first-stage control engine module of the rocket carrying the satellite." Satellite images also revealed that a new third-stage booster was delivered to the launch pad on Saturday.

A key issue is how far the rocket traveled and whether it was able to successfully separate its second and third stage rockets. If so, the capacity to travel long distances would be greatly enhanced.

The type of rocket is believed to be the Taepodong 2 missile. The North Koreans refer to it as the Unha-3, which in Korean translates as "Galaxy-3." The same type of missile has been previously tested three times in 2006, 2009 and 2012. Each time, the rocket failed soon after launch. It is believed to have the capacity to travel a minimum of 3,400 miles. That puts it well within striking range of the western U.S.

The U.S. had mobilized four warships in the Asia-Pacific region to monitor the launch. The guided missile destroyers the USS John S. McCain, the USS Benfold and the USS Fitzgerald joined the guided missile cruiser the USS Shiloh to "reassure allies in the region" according to officials.

South Korea's president Lee Myung-bak called an emergency security meeting in response. The timing is particularly sensitive for this country which is still officially at war with North Korea.

In just one week, South Korea holds key elections and will choose a new president. North Korea's successful launch could potentially sway voters favoring either a harsher line or a return to the "Sunshine Policy" of past administrations.

Current ruling party candidate Park Geun-hye has indicated a willingness to hold talks with North Korea.

Her father, Park Chung-hee, served as the South Korean president for 16 years. He was the target of multiple assassination attempts by North Korea. One of those efforts killed his wife, Chung-hee's mother.

Park took over her mother's duties as first lady until her father was assassinated by the chief of security in 1979. She re-emerged in 1997 as an active politician and is the first female candidate to be seriously considered for president.

Her party, the Saenuridang, is a traditionally conservative group that adapts a somewhat stricter policy towards North Korea that her opponent, Moon Jae-in. As head of the Democratic United Party, he champions a more lenient approach to the South's belligerent neighbor.

In repeated breaking news announcements throughout the day North Korean state-run television celebrated the launch. "We are proud of the glorious success of our satellite technology," said the presenter. "This is a landmark achievement."

Dec. 17 marks the one year anniversary of the country's Dear Leader Kim Jong-il's death. Analysts believe his son and successor, Kim Jong-Un, is under pressure to show the world he is intent on continuing his father's "Military First" policy and demonstrate a show of strength.

While experts do not believe North Korea currently has the technology to mount a nuclear warhead, today's launch is a significant development for the closed country's new leader.
